THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO CONTEMPT CASE No.199 OF 2015 ORDER:
The present contempt case is filed complaining that the respondent had deliberately, purposefully, wantonly and with malicious intention violated the directions issued by this Court, hence the respondent deserves to be proceeded against in contempt of court order.
Learned single Judge while entertaining the writ petition passed an interim order in WPMP.No.30387 of 2013 in W.P.No.24670 of 2013 on 10.09.2013. The order passed by this Court reads as under: "There shall be interim direction to continue the petitioner as PET until further orders."
When enquired into, the learned counsel for the petitioner is fair enough to submit that the petitioner is being continued as PET in furtherance of the above orders passed by this Court, but she was not paid her salary and wages attached to the post of PET. When once the respondent has complied with the order passed by this Court and continued the petitioner herein as PET, I cannot assume that there was any deliberate or willful violation of the orders passed by this Court.
However, since the petitioner has approached this Court, according to the learned counsel, the respondent got prejudiced and not paying the allowances attached to the post of PET. I am sure, if the petitioner makes out an appropriate case, the respondent will take up the issue with the competent authority for releasing the salary and allowances, if at all, the petitioner is positioned against the grant-in-aid
post, otherwise the respondent being the correspondent of the school is liable to pay the salary and allowances.
