HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.33083 of 2015 ORDER : (per Hon'ble Sri Justice R.Subhash Reddy) While issuing notice before admission, by order dated 08.10.2015, this Court allowed the 2nd respondent-Bank to proceed with the auction to be held on 09.10.2015 under the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, however, directed not to issue Sale Certificate to the third party-auction purchaser, on condition of the petitioner depositing Rs.13.50 Crores within three weeks from the date of the said order.
2. Thereafter, when the matter was listed on 29.10.2015, there was no representation for the petitioner and the learned Standing Counsel for 2nd respondent-Bank represented that the petitioner has not complied with the conditional order dated 08.10.2015. Again when the matter was listed on 03.12.2015, as there was no representation for the petitioner, the matter was directed to be listed under the caption "FOR DISMISSAL".
3. Even today, despite the matter being listed under the caption "FOR DISMISSAL", when the matter is called, there is no representation for the petitioner. It appears that the petitioner is not interested in pursuing the matter.
4. Accordingly, this writ petition is dismissed for nonprosecution. Interim order granted by this Court on 08.10.2015 is vacated. As a sequel, miscellaneous petitions pending, if any, shall
stand closed. No order as to costs.
