THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.18212 of 2006 ORDER:

This Writ Petition is filed for the following relief: "For the reasons stated in the accompanying affidavit, the petitioners herein pray that this Hon'ble Court may be pleased to issue a writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in demanding and collecting a sum of Rs.59,40,000/- towards the development charges from the petitioner for the release of 4950 KVA load as highly illegal, arbitrary, discriminatory and contrary to Sections 43 and 46 of the Electricity Act, 2003 read with Regulation No.3 of the A.P. Electricity Regulatory Commission (Licensees Duty for Supply of Electricity on Request) Regulation, 2004 if necessary by declaring Clause 5.3.3. of the General Terms and Conditions of Supply issued in the proceedings No.Secy/01/2007 dated 6.1.2006 of the 5th respondent as illegal and arbitrary."

When the matter is taken up, it is submitted by the learned counsel for the petitioner that the issue in the present Writ Petition is squarely covered by the common order, dated 05.10.2010 passed by this Court in Writ Petition No.4010 of 2005 and batch.

Learned Standing Counsel for Transmission Corporation does not dispute the aforesaid submission. He, however, submits that against the said common order, a Writ Appeal was filed,

CKR, J W.P.No.18212 of 2006 there is no stay granted in it by the Division Bench of this Court and the same is pending.

In those circumstances, following the above said common order and for the reasons recorded therein, this Writ Petition is also disposed of in terms thereof.

Office to annex a copy of the order, dated 05.10.2010, in Writ Petition No.4010 of 2005 and batch, to this order. Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
