THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.4675 of 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 Criminal Procedure Code, 1973 seeking regular bail to the petitioner/Accused in Crime No.381 of 2022 on the file of Jagadgirigutta Police Station, Balanagar, Cyberabad, registered for the offences punishable under Sections 354, 509 of IPC and Section 9 read with 10, 12 of POCSO Act, 2012. 2.

Heard learned counsel for the petitioner/Accused and the learned Assistant Public Prosecutor for the respondent-State. 3.

The case of the prosecution is that on 14.05.2022 a complaint was filed by the defacto complainant stating that she had borrowed an amount of Rs.2 lakhs from this petitioner and also paying interest. However, for the past 15 days the petitioner was behaving in an indecent manner and also he has behaved in a similar way with her brother-in-law's daughter. On the basis of the said complaint, the present crime came to be registered. 4.

Learned Counsel for petitioner submits that the defacto complainant filed the present false complaint for evading payment of Rs.2 lakhs.

Even according to the complaint, there are money transactions in between the petitioner and defacto complainant. However, keeping in view petitioner's detention from 25.05.2022, this Court is inclined to grant bail to the petitioner/Accused subject to the following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the XXXI Additional Metropolitan Magistrate, Kukatpally.

ii) The petitioner/Accused shall appear before the concerned Station House Officer on every Monday between 10.30 a.m. and 01.00 p.m. for a period of two

(02) months.

iii) The petitioner/Accused shall not contact the defacto complainant in any manner.

iv) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
