HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31032 of 2016 ORDER:
The case of the petitioner is that she is the owner and possessor of the land admeasuring Ac.1.74 cents in survey No.490-2A of No.87, Adenapalle Village Accounts, Adenapalle Grampanchayat, Pakala Mandal, Chittoor District by virtue of registered sale deed vide CS No.277/2014, Regular Document No.270/2014 dated 03.02.2014 and that the petitioner's vendors title is traceable to assignment granted on 20.04.1936 vide DKT No.614/45. When the petitioner wanted to sell the said land she and the intending purchaser/s approached the Sub-Registrar Office to know the valuation of the property and the amount of stamp duty payable for the land. But, the SubRegistrar refused to disclose the valuation and to register the document on the ground that it is an assigned land. Aggrieved by the same, present writ petition is filed.
Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Revenue submits that as on today no order refusing the registration is passed.
In view of the above, it is open for the petitioner to produce the document for registration before the 3rd respondent and the 3rd respondent Registration Act has to receive the same if the same is in order as per the Stamps and Registration Act and the Rules made thereunder. If he wants to refuse the registration, he has to record the reasons as envisaged under Section 71 of the
Act. Otherwise register the same. As petitioner asserts that the title of the petitioner is traceable to Assignment granted vide DKT Patta No.614/45, dated 20.04.1936, the petitioner can bring the said fact to the notice of the 3rd respondent and the 3rd respondent is to take the same in to account while considering the documents presented by the petitioner for registration. Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 17.09.2016 tk
