HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE D.V.S.S.SOMAYAJULU APPEAL SUIT M.P.No.2270 of 2017 in/and APPEAL SUIT No.163 of 2017 COMMON ORDER: (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) Vide A.S.M.P.No.2270 of 2017, the petitioner/appellant and respondent seek direction thereby to record the compromise between them and consequently to dispose of the appeal in terms of the compromise, by setting aside the judgment and decree dated 23.11.2016 passed in O.S.No.93 of 2007 on the file of the III Additional District Judge, Ranga Reddy District. The memorandum of compromise is at page Nos.14 to 17 of the affidavit filed in support of the petition.

Learned counsel appearing on behalf of the parties jointly state that matter has been compromised between the parties; thus, in terms of the compromise, the appeal may be disposed of as prayed. Keeping in view the averments made in the affidavit filed in support of the petition and the fact that compromise has taken place between the parties, we hereby record the compromise. Consequently, the judgment and decree dated 23.11.2016 in O.S.No.93 of 2017 on the file of the III Additional District Judge, Ranga Reddy District, is not executable.

A.S.M.P.No.2270 of 2017 is allowed as above. Consequently, A.S.No.163 of 2017 stands disposed of as compromised.

As a sequel, miscellaneous petitions if any pending in the appeal stand closed.
