HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CIVIL REVISION PETITION No.4429 OF 2015 ORDER:

The present revision petition, under Article 227 of the Constitution of India, is filed aggrieved over the order, dated 07.04.2014, passed in C.M.A.No.1 of 2014 on the file of learned I Additional District Judge, Medak at Sangareddy.

2. The aforesaid C.M.A. is filed by the petitioner aggrieved over the order, dated 04.11.2013, passed in I.A.No.1426 of 2012 in O.S.No.344 of 2012 on the file of learned Principal Junior Civil Judge, Sangareddy. The Court below, by the impugned order, dated 07.04.2014, dismissed the C.M.A.

3. Learned counsel for the revision petitioner fairly submits that after the present revision petition was filed, the suit in O.S.No.344 of 2012 on the file of learned Principal Junior Civil Judge, Sangareddy, was dismissed for default on 11.07.2017 and an application to set aside the said dismissal order was filed and is pending.

4. In such an event, the present revision petition becomes infructuous. However, the learned counsel for revision petitioner requests to grant liberty to the revision petitioner to file an application for recalling the present order, in case, the suit is restored to file.

5. Learned counsel for the respondent is present.

6. In view of the submission made by the learned counsel for the revision petitioner, the present revision petition is disposed of granting liberty to the revision petitioner to file an application to recall the present order, in case, the suit is restored to file.
