THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4533 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C."), seeking to enlarge the petitioner/Accused No.2 on bail in connection with COR No.35 of 2022 on the file of Prohibition and Excise Police Station, Narayankhed, registered for the offence punishable under Section 8(c) read with 22 (C) of N.D.P.S.Act, 1985.

Heard learned counsel for the petitioner/Accused No.2 and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that when the Prohibition and Excise Officials conducted raid in the premises of Accused No.1's house bearing No.2-3-142/C/3/9, A.S.Nagar, Narayankhed, the petitioner was found in possession of a Green colour bag and after following due process, the officials have found 1.150 Kgs of Alprazolam. Even according to the Police Officials, the petitioner was present at the scene, which is the house of A-1 and admittedly the seizure was affected at the instance of A-1.

As per the instructions of the learned Assistant Public Prosecutor, there are no other criminal antecedents as far as this petitioner is concerned.

In the said circumstances, when nothing is seized from the petitioner/Accused No.2, this Court is inclined to grant bail to the petitioner/Accused No.2 on the following conditions: i) The petitioner/Accused No.2 is directed to be released on bail on his executing personal bond for Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for like sum each, to the satisfaction of I Additional District and Sessions Judge, Medak at Sangareddy District. ii) The petitioner/Accused No.2 shall appear before the concerned Police on every Monday between 10.00 A.M to 05.00 P.M, for a period of three months or until filing of charge sheet, whichever is earlier.

iii) The petitioner/Accused No.2 shall comply with the conditions as laid down under Section 437 (3) of Cr.P.C. Accordingly, the criminal petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
