HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.17539 of 2019 ORDER:
When the matter is taken up for hearing, it is represented by learned counsel for the petitioners that in identical circumstances, this Court disposed of Writ Petition No.12824 of 2017 by an order dated 11.04.2047 and a copy of the same is placed on record along with the Writ Petition as material paper.
The operative portion of the said order reads as under: "In those circumstances, the writ petition is disposed of with a direction to the respondent authorities to process the application of the petitioners for consideration of the building permission within a period of eight (08) weeks from the date of receipt of a copy of this order, subject to satisfying requirement of Section 428 of Greater Hyderabad Municipal Corporation Act, 1955, and also giving an undertaking that the petitioners would not claim equities or costs of the building construction, in the event of the writ petition file d by the Government has been decided against them. It is also made clear that the permission is liable to be cancelled in the event of the writ petition filed by the Government is allowed without any further notice. No costs."
Following the above said order and for the reasons recorded therein, the Writ Petition is also disposed of, in terms thereof. Office to enclose a copy of the order dated 11.04.2017 in W.P.No.12824 of 2017 to this order. The respondent authorities are directed not to interfere with the construction activity being carried out by the petitioners in the subject plots as long as the construction permission granted in their favour is valid. Pending Miscellaneous Petitions, if any, shall stand closed. No order as to costs.
