THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.11317 OF 2010 ORDER:

This writ petition is filed challenging the action of the respondents 4 and 5 in interfering with the civil disputes between the petitioners and 5th respondent in respect of the land to an extent of Ac.7.06 cents in R.S.No.231/1,4,13,14,15,233/3, 14-B,235/5,238/4 and 6 of Munjaluru village, Bantumilli Mandal of Krishna District.

There was no interim order granted by this Court while admitting the writ petition on12-05-2010.

In view of the same, it cannot be said that the cause of action in the writ petition survives as on today. However, the learned Government Pleader produced an order passed by the Executive Magistrate & Tahsildar, Bantumilli, issued under Section 145 Cr.P.C. on 01-05-2010 along with counter affidavit. It appears that the dispute pertains to land in R.S.No.238/06, measuring an extent of Ac1.76 cents. 4.

In view of pendency of proceedings under Section 145 Cr.P.C. liberty is given to the petitioners to take appropriate proceedings in accordance with law.

5. Accordingly, the writ petition is closed. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
