THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.15275 OF 2018 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Land Acquisition.
According to the petitioners, they are the residents of Taduvai Village, Jangareddygudem Mandal, West Godavari District and owned the lands in the said village. The respondent authorities acquired the said lands for Chintalapudi lift irrigation scheme and the Land Acquisition Officer passed an award on 13.10.2015. Aggrieved by the quantum of compensation awarded by the Land Acquisition Officer, the petitioners submitted an application before the District Collector on 12.02.2018, for referring the matter to a competent authority for enhancement of the compensation amount.
It is submitted by the learned counsel for the petitioners that though the petitioners herein submitted an application on 12.02.2018, no action has been taken by the District Collector for referring the matter to the competent authority under Section 64 of the Right to Fair Compensation in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short 'the Act'). Having heard the learned counsel for the petitioners and the learned Government Pleader and as the application filed by the petitioners herein is pending consideration before the District Collector, West Godavari District, this Court deems it appropriate to dispose of the writ petition with a direction to the 4th respondent to take steps on the application dated 12.02.2018 submitted by the petitioners herein for referring the matter under Section 64 of the
Act, as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order. The Writ Petition is disposed of, accordingly. There shall be no order as to costs.
Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
