Heard Sri P.Srinivas Rao, learned counsel for the petitioner and the learned Government Pleader for Services-I. With the consent of learned counsel for the respective parties, this Writ Petition is disposed of at the admission stage. This Writ Petition is filed for the following relief: ".........Writ of Mandamus or any other appropriate writ to set aside the impugned orders issued in Memo No.237/Vig.A1./2019.1 dated 30.01.2019 by the 1st respondent and proceedings No.231067/E/2019 dated 02.02.2019 issued by the 2nd respondent placing the petitioner under suspension, is being arbitrary, illegal and unconstitutional and further direct the respondents to reinstate the petitioner into service as Assistant Geologist............"
It has been contended by the petitioner that he is working as a Assistant Geologist and has been discharging his duties to the best satisfaction of his superiors and everyone concerned. While so, on a private complaint made by one Smt.Mahalaxmi, the petitioner was placed under suspension vide proceedings dated 30.01.2019 and 02.02.2019 alleging abuse of official position and involvement in granite business.
Learned counsel for the petitioner contends that it has been almost 6 months, the respondents have not reviewed the suspension orders dated 30.01.2019 and 02.02.2019.
Therefore, he contends that appropriate orders be passed in the writ petition directing the respondents to review the suspension orders, as per G.O.Ms.No.86, dated 08.03.1994 and pass appropriate orders in accordance with law. Learned Government Pleader appearing for the respondents contends that the disciplinary authority would consider the case of the petitioner and review the suspension orders passed against him, strictly in terms of G.O.Ms.No.86, dated 08.03.1994.
This Court, having considered the rival submissions made by the learned counsel on either side, is of the considered view that this writ petition can be disposed of directing the respondents to review the suspension orders passed against the petitioner strictly in terms of G.O.Ms.No.86 dated 08.03.1994 and pass appropriate orders in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
With the above observations, this writ petition is disposed of. No order as to costs.
As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
