HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.19411 OF 2002 ORDER:

This writ petition is filed challenging the order passed by the 1st respondent dated 30.8.2002 surrendering the petitioner to the 3rd respondent.

The learned Counsel for the petitioner submitted that on 4.10.2002, while admitting the writ petition, this Court granted interim suspension of the order dated 30.8.2002, and in pursuance of the said interlocutory order, the petitioner was reinstated into service and he also retired from service on attaining the age of superannuation. The learned Counsel for the petitioner further submitted that if the petitioner is entitled for any terminal benefits, he may be permitted to make a representation to the respondents, and the respondents may be directed to consider such representation.

This Court having considered the above submissions is of the view that the writ petition can be disposed of directing the petitioner to submit a representation to the respondents within one week claiming terminal benefits to which he is entitled. 4.

Accordingly, the Writ Petition is disposed of directing the petitioner to submit a representation to the respondents claiming terminal benefits, to which he is entitled, within one

week from the date of receipt of a copy of this order. On such representation being made, the respondents shall consider the same and pass appropriate orders in another four weeks thereafter. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
