THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 21931 of 2016 ORDER:

The petitioner is the Sarpanch of Yerragudipadu Gram Panchayat, Chimakurthy Mandal, Prakasam District. He submitted a representation dated 13.05.2016 to the 4th respondent District Panchayat Officer, Ongole alleging that the 5th respondent Extension Officer (PR & RD), Chimakurthy Mandal, who is also stated to be facing disciplinary proceedings, and the Panchayat Secretary are meddling with the powers conferred on the Sarpanch i.e. the petitioner, in violation of the provisions of the Andhra Pradesh Panchayat Raj Act, 1994 and the Rules framed there under and hence, requesting to post the 5th respondent in non-focal areas. So far, no action has been taken on the said representation is the basis for the petitioner to institute this Writ Petition.

Heard learned counsel for the petitioner as well as learned Government Pleader for Panchayat Raj (Andhra Pradesh). Since the main grievance of the petitioner is that the 4th respondent has not acted on the representation submitted by him on 13.05.2016, it would be appropriate for this Court, without going into the merits of the matter any further, to give a direction in that regard. Hence, the Writ Petition is disposed of, directing the 4th respondent to examine the representation dated 13.05.2016 submitted by the petitioner and pass orders considered appropriate, as expeditiously as possible. No costs.

Consequently, the Miscellaneous Applications, if any shall also stand disposed of.
