HON'BLE SRI JUSTICE T. SUNIL CHOWDARY TRANSFER C.M.P.No.260 of 2016 ORDER:

This petition is filed under Section 24 C.P.C., seeking to withdraw M.O.P.No.5 of 2015 on the file of the Court of Principal Senior Civil Judge, Kurnool, and transfer the same to the file of Judge, Family Court, at Miyapur, Ranga Reddy District, for disposal in accordance with law.

Heard both the counsel and perused the material available on record.

At the time of arguments, the only relief sought by the learned counsel for the petitioner is to dispense with the presence of the petitioner on each and every date of adjournment. The petitioner is a woman, therefore, the relief sought by her is justified.

In view of the submissions made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case and also the submissions made by the learned counsel for the petitioner, the presence of the petitioner, who is respondent in M.O.P.No.5 of 2015 on the file of the court of Principal Senior Civil Judge, Kurnool, is dispensed with on each and every date of

adjournment. However, she shall appear before the Court as and when her presence is so required.

With the above direction, the transfer C.M.P. is disposed of. As a sequel, miscellaneous petitions, pending if any shall stand closed.
