HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.30165 of 2010 ORDER:

The relief sought for in the Writ Petition is to declare the action of the first respondent, in not allotting the duties to the petitioner on par with his juniors, as illegal and arbitrary. The petitioner was appointed as a contract driver, and worked with the 2nd respondent for a period of three months. His services were, thereafter, disengaged. A notice dated 01.03.2008 was sent to him by the first respondent for further posting orders. The petitioner claims that, when he went to the first respondent, he was informed that there was no need to report at Kurnool R.M. Office; and a notice would be sent to his house. On the ground that others were engaged while he was not, the petitioner invoked the jurisdiction of this Court by way of the present Writ Petition.

By way of an interim order, this Court directed that, in case the petitioner is on the rolls of the respondent-Corporation, the second respondent shall assign duties to the petitioner on par with persons enlisted along with him.

The case of the respondent-Corporation is that, since the petitioner was not on the rolls of the 2nd respondent, his services were not engaged. In any event, the petitioner was engaged as a contract driver for a period of just three months; and such engagement does not confer on him any right to claim

that his services should be continued, or that his services should be regularized.

The Writ Petition, as filed, is wholly misconceived and is, accordingly, dismissed. The miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
