THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34873 of 2016 ORDER:

The writ petition is filed by the petitioners seeking a writ of mandamus declaring the action of the respondents 3 to 5 in interfering in the civil dispute and calling the petitioners to the police station and made the petitioners to sit unnecessarily though civil suit is pending in the competent civil courts between the petitioners and the respondents 6 and 7 as illegal and arbitrary and consequent to direct the respondents 3 to 5 not to interfere in the civil disputes between the petitioners and respondents 6 and 7.

Heard and perused the material.

Learned counsel for the petitioner submits that the respondents 3 to 5 are interfering in the civil dispute between the petitioners and the respondents 6 and 7 and that respondents 3 to 5 are calling the petitioners to the police station and made them to sit in the police station hours together unnecessarily and as such, he prays this Court to direct the respondents 3 to 5 not to interfere in the civil disputes between the petitioners and respondents 6 and 7. Learned Assistant Government Pleader for Home (Telangana) submits that the respondents 3 to 5 are not interfering in the civil disputes, more particularly, the civil dispute between the petitioners and respondents 6 and 7.

Considering the rival submissions made by both the counsel, the writ petition is disposed of with a direction to the respondents 3 to 5 not to interfere in the civil disputes between the petitioners and respondents 6 and 7 and not to call the petitioners to the police station and to follow the due process of law laid down in Code of Criminal Procedure.

However, this Order will not come in the way of any investigation by respondents 3 to 5, if any case is registered for cognizable offence on the basis of the complaint given by respondents 6 and 7 or by any other person.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 18.10.2016 pln
