O R D E R

This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused seeking to enlarge him on bail in connection with Crime No.533 of of Chaitanyapuri police station, L.B.Nagar, Malkajgiri Division. The offences alleged against the petitioner are punishable under Sections 64 (1), 78, 329 (4) and 351 (2) of the BNS Act. 2.

The case of the prosecution is that on 15.04.2026 the de facto complainant (victim) came to the police station and a lodged report, wherein it is stated that she resides on

- 2 - the 2nd floor along with her family. In the month of September, 2025, on one night at around 23:30 hours, she heard a knock at the door and thinking that it was her husband and she opened the door. However, a person by name suresh, who is the petitioner herein resides on the 1st floor of the same apartment, forcefully entered into the house and raped her. Hence, she requested the police to take necessary action against the said complaint. Basing on the same, police registered a case against the petitioner for the aforesaid offences.

Heard Ms.Nomula Katyayani, learned counsel for the petitioner/Accused and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor, appearing for the respondent-State.

The contention of learned counsel for the petitioner is that the petitioner is innocent of the offences alleged against him; that he has been falsely implicated in this case, but in fact the petitioner is a resident of Suryapet District and in the month of August, 2025, he met with an accident and during that period he has been taking treatment at his native place; that for inordinate delay in lodging the

- 3 - report, there is no specific date in the complaint about the alleged incident and that the petitioner has been in judicial custody since 16.04.2026 and that entire investigation is already completed and as such requested the Court to grant regular bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed the same and submits that though there is a delay in lodging the report, as the petitioner herein threatened the victim she did not lodge the report within the time; that the offences alleged against the petitioner are grave in nature and at this stage, the petitioner is not entitled for grant of bail and hence, he prays to dismiss the petition. 6.

Considering the submissions made by learned counsel for both parties and perusal of the material on record, the petitioner has been in judicial custody from 16.04.2026. As seen from the record, L.Ws1 to 11 were examined including the Investigating Authority. Considering the delay in lodging the report and considering the period of incarceration of the petitioner in judicial custody, this Court deems it fit to grant bail to the petitioner/Accused subject to the following conditions:

- 4 - (i) The petitioner-accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned XIII Additional District Judge, Ranga Reddy District. (ii) On such release, the petitioner-accused shall appear before the concerned S.H.O. between 09:00 a.m., and 5:00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) The petitioner-accused shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
