THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18019 of 2019 O R D E R :

This writ petition is filed challenging the action of the respondents in not registering the crime against the persons who trespassed into the house of the petitioner and threatened with dire consequences to handover the land in Survey No.105, to an extent of Ac.4.33 1⁄2 gts., situated at Naspur Village and Mandal, Mancherial District, basing on the complaint of the petitioner dt.05.08.2019. Learned Assistant Government Pleader for Home produced written instructions dt.19.08.2019, submitted by the Sub-Inspector of Police, CCC Naspur P.S., Mancherial District. To the extent of their relevance to the present writ petition, the said instructions read as under.

"It is submitted that on receipt of above complaint, GD entry was made and enquiry was done, during enquiry it was disclosed that the said Salvaji Bhavanthrao and others are her blood and close relatives and they came to the petitioner's house on knowing about deteriorating of his grand mother's health condition and taking advantage of it she has given the false complaint, further her grandmother also given complaint against her on the same day informing that she is not looking after her. It is submitted that the Station House Officer tried to inform the petitioner that the complaint given by her is false, but as she was not availed at her residence, a Notice was sent to the petitioner through registered post on 17.08.2019 informing that the complaint is closed as false and directed her to approach the civil court for necessary remedy."

Recording the aforesaid written instructions, the writ petition is disposed of granting liberty to the petitioner to avail alternate remedy as may be available to him under law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
