HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 33042 OF 2017 ORDER:
This writ petition is filed assailing the impugned order No.A4/E-523729/2017, dated 04.02.2017 issued by the 2nd respondent in imposing major penalty i.e, compulsory retirement from service, as illegal and arbitrary. Heard learned counsel for the petitioner.
Admittedly, the subject matter is a service matter and the petitioner has to approach Andhra Pradesh Administrative Tribunal in terms of judgment of the Hon'ble Supreme Court in the case of L.Chandra Kumar v. Union of India1 and when the same is pointed out, learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition with liberty to approach Andhra Pradesh Administrative Tribunal. Permission is accorded.
Recording the submission of the learned counsel for the petitioner, this writ petition is dismissed as withdrawn with the liberty sought for.
