- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.503 of 2014 ORDER :

W.P.No.2325 of 2009 was disposed of by order dated 04.03.2009 directing the respondents to retain the original seniority of petitioner in the cadre of Conductor in Hyderabad City Region. Alleging violation of the said direction, this contempt case is filed.

In the counter affidavit filed by the 2nd respondent, it is averred that seniority of the petitioner was restored and he was promoted as Junior Assistant (F) vide proceedings dated 04.06.2009, and further promoted as Senior Assistant (F) on 23.01.2015.

Learned counsel for the petitioner sought to contend that promotions granted to petitioner were in the normal course and not on account of revision of seniority as directed by this Court. 4.

From a reading of the order of this Court, the direction issued by this Court is only to retain the seniority of the petitioner in the cadre of conductor in Hyderabad City Region and no further directions were issued. If petitioner has grievance regarding the date of promotion as Junior Assistant or to the higher post, it is for him to work out his remedies and merely because petitioner is not granted promotion as and when it is due as per his claim, it cannot be said that the respondents have violated the direction of this Court much less deliberate and willful, warranting initiation of contempt proceedings against them.

Contempt case is accordingly closed. Pending miscellaneous petitions, if any, shall stand closed.
