THE HON'BLE JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.9575 of 2009 ORDER:

The petitioner seeks a Writ of Mandamus to declare the inaction of the respondent-Cantonment Board in considering the application dated 23.04.2009 submitted by the petitioner for release of the building permission for construction of residential premises at H.Nos.3-7-218, 219 and 220 in Sy.Nos.51 to 54 at Kakaguda Village, Secunderabad as illegal, unjust and discriminatory and consequently direct the respondent to release the building permission without insisting for the layout based on the recommendations made by the Directorate of Defence Estate dated 22.04.2009 in Order No.17679/SBD/DE. 2) It is seen that respondent has not filed counter. It is further seen that in WPMP No.12480 of 2009 dated 30.04.2009 this Court passed the following interim order.

"There shall be interim direction to the respondent to consider releasing of the building permission pursuant to the recommendation made by the Directorate of Defence Estate on 22.04.2009 in Order No.17679/SBD/DE without insisting for layout, within three weeks from the date of receipt of a copy of this order." 3) When the matter came up for hearing, learned counsel for petitioner would submit that writ petition may be closed in terms of interim order passed in WPMP No.12480 of 2009, dated 30.04.2009.

4) In view of above submission, this Writ Petition is disposed of in terms of interim order passed in W.P.M.P.No.12480 of 2009 dated 30.04.2009. As a sequel, miscellaneous application pending, if any, shall stand closed. _________________________ U. DURGA PRASAD RAO, J Date: 12.10.2018 Murthy
