HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.148 of 2016 ORDER:

This petition is filed to withdraw O.P.No.608 of 2014 from the file of VII Additional District Judge, Gudur, SPSR Nellore District and transfer the same to Family Court, Guntur, Guntur District.

2. Wife filed this petition. According to her affidavit her marriage with respondent was performed on 12.08.1998 and they are blessed with two children and they are now aged about 17 years and 15 years respectively. She stated that she was harassed and necked out along with her children on 16.7.2010 and that she lodged a complaint with police for the offence under Section 498-A IPC and thereafter she filed M.C. No.18 of 2010 before I Additional Junior Civil Judge, Sattenapalli, who granted maintenance of Rs.2,000/- per month to each of them and respondent filed O.P. before VII Additional District Judge, Gudur for dissolution of marriage.

She further stated that she has no source of income and it is difficult for her to travel from Sattenapalli to Gudur, which is nearly 300 KMs and that she is residing with her father, who is aged about 75 years. She further stated that she has no relatives at Gudur to take shelter and she is completely dependent on her father and not in a position to bear traveling expenses. She stated that respondent is a Government employee and earning reasonable and decent salary, and O.P. is filed only to harass her. She stated that her daughter is studying II year intermediate and preparing for academic and entrance examinations for future courses, for which, her assistance is required.

For these reasons, she prayed for transfer of

O.P.No.608 of 2014 from Gudur to Guntur.

3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

4. Heard advocate for petitioner.

5. Considering the reasons stated in the affidavit and also considering the convenience of wife, O.P.No.608 of 2014 is withdrawn from the file of VII Additional District Judge, Gudur, SPSR Nellore District and transferred to Family Court, Guntur for disposal in accordance with law.

6. Accordingly, this Transfer Civil Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed. __________________ S. RAVI KUMAR, J Date: 20-04-2016 gvl
