THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.2101 of 2009 ORDER:

This Writ Petition is filed challenging the proceedings of the respondents dated 24.12.2008 keeping the petitioner under suspension for misappropriation of an amount of Rs.7,28,000/-.

It is represented by the learned Counsel for the petitioner that though at one point of time the petitioner sought no objection, but later on he did not turn up, and now he has no instructions to argue the matter.

The petitioner was aged about 51 years when the Writ Petition was filed and now he must have attained superannuation. Be that as it may, in the present case initially the order of suspension was suspended by order dated 09.02.2009 and later on, upon filing a vacate petition, the said order was vacated by order dated 19.04.2010 and the enquiry was directed to be completed within a period of three months from the date of receipt of a copy of the said order. Even after taking time by the learned Counsel for the respondents on 21.06.2017, learned Counsel for the respondents could not report to this Court with regard to the stage of enquiry.

In view of the order of this Court dated 19.04.2010, the enquiry must have been completed.

In the circumstances, the Writ Petition has become infructuous, and the same is accordingly dismissed as infructuous. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
