THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.15493 of 2018 ORDER:

This Writ Petition is filed seeking to declare the action of the second respondent, in not releasing Mahindra Bolero vehicle bearing Reg.No.TS-26-T-1869 seized in C.O.R.No.34/2018 on the file of the Station House Officer, Wyra Prohibition & Excise, Khammam District, inspite of readiness of the petitioner to furnish third party surety, as illegal and arbitrary. Having heard the learned counsel for the petitioner and the learned Government Pleader for Excise appearing for the respondents, this Writ Petition is disposed of, leaving it open for the petitioner herein to move an appropriate application before the Deputy Commissioner of Prohibition & Excise, Khammam Districtsecond respondent herein, for release of the seized vehicle, under the provisions of the A.P.Excise Act, within a period of one week from today, and with a direction to the second respondent to decide the application, if any, filed in the said direction by the petitioner herein, within a period of two weeks thereafter. There shall be no order as to costs.
