THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA Writ Petition No.30358 of 2016 ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) The petitioner has an effective alternative remedy, of an appeal to the A.P. VAT Appellate Tribunal, against the order dated 25.07.2016 passed by the Appellate Deputy Commissioner (CT), Vijayawada. Without availing the alternative remedy, the petitioner has invoked the jurisdiction of this Court under Article 226 of the Constitution of India. In view of the alternative remedy of appeal, we see no reason to exercise discretion, under Article 226 of the Constitution of India to interfere. Leaving it open to the petitioner to avail the remedy of an appeal, under the A.P. Value Added Tax Act, 2005, to the A.P.VAT Appellate Tribunal, the Writ Petition is dismissed. Miscellaneous petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
