THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37986 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a direction to respondent No.3 not to interfere with the civil disputes pending before the petitioners and respondent Nos.4 to 8 and not to dispossess the petitioners from their lands admeasuring Ac.1.36 cents situated in Sy.No.128/1A, Ac.4.62 cents situated in Sy.No.128/1C, Ac.2.28 cents situated in Sy.No.131/2 and Ac.1.84 cents situated in Sy.No.131/4 of Valabu Village, Devarapalli Mandal, Veeravalli Sub-Division, Visakhapatnam District.

Heard and perused the material available on record. 3.

Learned Assistant Government Pleader for Home denied the entire allegations and submitted before this Court that respondent No.3 is not interfering with the civil disputes pending before the petitioners and respondent Nos.4 to 8.

Considering the rival contentions of both parties, this Court is of the view that the writ petition can be disposed of with the following direction:

Respondent No.3 is hereby directed not to interfere in any of the civil disputes pending before the petitioners and respondent Nos.4 to 8. At the same time, the present order will not stand in the way of respondent No.3 to proceed with the investigation if

any complaint is registered against the petitioners for a cognizable offence.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
