HON'BLE SRI JUSTICE S.V.BHATT CONTEMPT CASE No.1376 of 2014 ORDER:
Heard Mr.D.Kasim Saheb for petitioner and the learned Assistant Government Pleader for Revenue.
The Contempt Case is filed complaining disobedience of order dated 06.03.2014 in W.P.No.4890 of 2014. The operative portion of the order dated 06.03.2014 in W.P.No.4890 of 2014 reads as follows :- " Since the notice was already issued by respondent Nos.2 and 3 to all the persons effected, they shall take appropriate steps for completion of survey in accordance with law and then, issue a copy of survey report to the petitioner expeditiously.
The 2nd respondent filed counter affidavit reporting compliance of the directions issued by this Court. In support of the assertion that survey is undertaken and completed, the 2nd respondent relies on the panchanama conducted on 02.09.2014. The panchanama records the absence of petitioner at the time of survey. Therefore, prima facie this Court is of the view that the respondents in the writ petition have not placed correct details before the Court.
The Assistant Government Pleader draws the attention of the Court to the circumstance that the 2nd respondent has retired from service. He submits that the Tahsidar, Kolluru Mandal, Guntur
District-3rd respondent in W.P.No.4890 of 2014 undertakes survey after issuing notice to petitioner.
After seeing the stage at which the disobedience is complained and the fact that the 2nd respondent is no more in service, the Contempt Case is closed by giving liberty to the Tahsidar, Kolluru Mandal, Guntur District, to issue notice to petitioner and complete survey as directed by this Court in W.P.No.4890 of 2014 within eight weeks from the date of receipt of a copy of this order.
To avoid argument on whether notice is served on petitioner or not, the Tahsidar, Kolluru Mandal, Guntur District, sends notice to petitioner by registered post with acknowledgment due and does the needful within the time stipulated by this Court.
