FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH **** WRIT PETITION NO.32617 OF 2015 DATED 25th NOVEMBER, 2015 Between:

Smt.Pitta Kumari .. Petitioner and The State of Andhra Pradesh, Rep. by its Secretary, Home Department, Secretariat Buildings, Hyderabad, and others.

THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.32617 OF 2015

O R D E R

The grievance of the petitioner was that the police authorities were not taking action on her complaint dated 20.08.2015.

The Sub-Inspector of Police, Pithapuram Town Police Station, East Godavari District, furnished written instructions dated 12.10.2015 to the office of the learned Government Pleader for Home, wherein he stated that no complaint dated 20.08.2015 was received by the police authorities.

Smt.A.S.Lakshmi, learned counsel for the petitioner, contended that the complaint dated 20.08.2015 was not received by the Station House Officer of Pithapuram Town Police Station, East Godavari District, and therefore the statement made by the police authorities to that effect is only self-serving.

Section 154(3) Cr.P.C. provides the remedy to the complainant in the event the Station House Officer of the Police Station concerned refuses to receive the complaint. Smt.A.S.Lakshmi, learned counsel, is unable to demonstrate before this Court as to whether the petitioner took recourse to this alternative remedy. In that view of the matter, the writ petition is closed leaving it open to the petitioner to take recourse to the measures available in terms of Section 154(3) Cr.P.C. with regard to submission of her complaint. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ______________________ SANJAY KUMAR, J 25th NOVEMBER, 2015 PGS`
