The petitioner-M/s Signs Outdoor Advertising challenges the Notice dated 20.06.2019 issued by the 3rd respondent, GHMC, levying a penalty of Rs.3,15,240/-, on the allegation that it is displaying the advertisement beyond the agreement period. Heard learned counsel for the petitioner, and the learned Standing Counsel appearing for the respondents.
The petitioner placed on record the agreement signed in the year 2014. As per the agreement signed between the parties, the agreement is for a period of ten years starting from 01.02.2011 to 31.12.2021, and therefore the agreement is still in force. In other words, the allegation that the petitioner is displaying the advertisement board even after expiry of the agreement period is contrary to the material on record. Learned Standing Counsel, on instructions, would submit that the respondent authorities didn't have the benefit of an agreement copy at the relevant point of time when the impugned notice was issued, however, in the light of the agreement copy produced by the petitioner, the impugned notice would be withdrawn. Accordingly, the writ petition is disposed of in the light of the submission made by the learned Standing Counsel on behalf of the respondents-Corporation. No costs.
