THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.910 of 2004 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the Respondents in not fixing and paying the pay scales as provided under 1993 and 1999 P.R.Cs and also not paying the said benefits and arrears and not continuing the same as highly arbitrary, illegal and violative of Articles 14, 16 and 21 of the Constitution of India and consequently to direct the respondents to fix the pay of the petitioner as per the Revised pay scales of 1993 and 1999 P.R.Cs with all arrears. At the time of arguments, the learned counsel for the petitioner submitted that the respondents have granted the benefits to the petitioner. It is not out of place to extract the relevant portion in para No.
5 of the counter filed by the 2nd respondent, which reads as under: "Later the petitioner was transferred to Mandal Parishad, S.N. Padu with post due to closure of the Aided Elementary School. As per the above G.O. Pay scales of 1993, 1999 were granted to the petitioner vide proceedings RC.No.1/2005/MEO dated 17.01.2005 of the Mandal Educational Officer, S.N.Padu."
In view of the submissions made by the learned counsel for the petitioner and also the categorical statement made by the 2nd respondent in the counter, as extracted above, no further orders need be passed in this Writ Petition.
4 Accordingly, the Writ Petition is dismissed. No order as to costs. As a sequel, miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
