THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.37122 of 2016 ORDER:

The petitioner challenges Proceedings No.01/ 122(7)/ 2016DM/ AVG dated 23-09-2016. The subject matter of the writ petition relates to contract work of HSD Oil Top-up awarded to petitioner by respondents.

On 27-09-2016, the petitioner has given representation and also a firm commitment to execute the contract work. No doubt, the respondents have jurisdiction and also discretion in contractual matters.

After perusing the representation and also the steps taken by the petitioner, to meet the ends of justice, this court is of the view that the 4th respondent can be directed to examine the representation dated 27-09-2016, if circumstances warrant, put further conditions on petitioner for execution of subject contract and pass appropriate orders within one week from today. The petitioner is given liberty to re-submit representation dated 27-09-2016 to 4th respondent within three days by enclosing a copy of this order.

The writ petition is disposed of accordingly. No order as to costs.
