THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.5012 of 2018 ORDER:

This Criminal Petition, under Section 438 Cr.P.C., is filed to enlarge the petitioner on bail in the event of his arrest as he is apprehending arrest in connection with Crime No.144 of 2018 on the file of Nacharam Police Station, registered for the offenc es under Sections 354, 509 and 506 IPC. After arguing the matter for awhile, learned counsel for the petitioner, requested this Court to direct the concerned to follow the procedure contemplated under Section 41-A Cr.P.C., and the guidelines issued by the Apex Court in Arnesh Kumar v. State of Bihar and another1 In view of the request made by the learned Counsel for the petitioner, the Police of Nacharam Police Station, Rachakonda District, are directed to follow the procedure contemplated under Section 41-A Cr.P.C., and the guidelines laid down by the Supreme Court in Arnesh Kumar's case referred supra.

With the above direction, this Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
