HON'BLE SRI JUSTICE A. SHANKAR NARAYANA TRANSFER C.M.P. No.668 OF 2016 ORDER:
Heard Sri M. Ajay Kumar, learned counsel for the petitioner - wife.
2. No representation for the respondent - husband.
3. The petitioner - wife seeks withdrawal of O.P. No.39 of 2016 on the file of the Principal Senior Civil Judge, Mancherial and to transfer the same to the file of the Judge, Family Court, Warangal, on the ground that she has been residing with her parents at Warangal and it is too difficult for her to travel to Mancherial. In fact, the learned counsel also would submit that the respondent is also residing at Beemaram, Hanamkonda, but deliberately has chosen to file the aforesaid O.P. before the Court at Mancherial, to cause harassment to the petitioner.
4. Be that as it may, when the averments in the petition are not being challenged by filing a counter and since the petitioner requires male assistance to travel to Mancherial from Warangal, which is at a distance of about 200 kilometers, it would be reasonable to acceded to the request.
5. Therefore, the present Transfer C.M.P. is allowed. O.P. No.39 of 2016 pending on the file of the Principal Senior Civil Judge,
ASN,J Tr.CMP No.668 of 2016 Mancherial is withdrawn and transferred to the Judge, Family Court, Warangal, for disposal in accordance with law.
6. On receipt of the cause bundle, the learned Judge, Family Court, Warangal, shall issue notices to both parties. As a sequel thereto, miscellaneous petitions, if any, pending in the Transfer CMP, stand closed.
