The petitioner herein was the second respondent in A.R.C.No.1 of 2007 pending on the file of the third respondent. He filed I.A. No.3 of 2009 seeking to club A.R.C. No.1 of 2007 with A.R.C. Nos.2 of 2007 and 3 of 2008 and take up the same for trial/hearing on the same date. The said application was dismissed by an order dated 17.11.2009. Against the same C.T.A. No.68 of 2009 was filed and the order passed by the third respondent was confirmed on 04.01.2010. Challenging the said order, the present Writ Petition was filed.

As could be seen above, A.R.C.

Nos.2 of and 3 of 2008 were pending before the third respondent and it is submitted that they are at an advanced stage. No useful purpose would be served by adjudicating the present Writ Petition arising out of an application seeking clubbing of those proceedings with A.R.C.No.1 of 2007. In view of the same, the present Writ Petition has become infructuous. The Writ Petition is, accordingly, dismissed as infructuous. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
