The Court made the following: [order follows] WRIT PETITION NO. 24720 OF 2009 O R D E R :
The petitioner prays for mandamus, declaring the action of first and second respondents in not issuing loan clearance certificate as well as not releasing the original registered document No. 1424/1997 after accepting the payment of loan amount as arbitrary, illegal and consequently direct the respondents 1 and 2 to issue loan clearance certificate and the original registered document No. 1424/1997.
2. On 11/3/2016 WPMP.No.36553 of 2010 filed by Smt.G.Padma to implead her as respondent No.3 was accepted. With the impleadment of Smt.G.Padma, as one of the respondents, the complexion of controversy is completely changed. The learned counsel for the petitioner, having regard to subsequent development in the writ petition requests the Court to permit the petitioner to withdraw the writ petition with liberty to avail the remedies available in law in a properly instituted suit or
proceeding.
3. The writ petition is dismissed as withdrawn by granting liberty as above. No order as to costs.
4. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
