Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.
2. The petitioner was appointed as a permanent fair price shop dealer of shop No.17 of Gudipadu Village, Gudur Mandal, Kurnool District. The authorization of the petitioner was suspended on 23.05.2015 based on the report submitted by the Deputy Tahsildar, Atmakur dated 21.05.2015. Challenging the same, the present Writ Petition is filed.

A perusal of the impugned order shows that no variations were found between book balance and ground balance, but the petitioner has not shown the stock register of kerosene oil and not distributed the kerosene oil to the cardholders as on 21.05.2015. The other allegations with regard to the less weighments and not storing the stock in the authorized place were indicated in the impugned order of suspension. This Court noticed that the allegations leveled are routine in nature.
4. In view of the same, the impugned order dated 23.05.2015 passed by the second respondent to the extent of suspending the authorization is set aside. However, the second respondent is given liberty to conduct an enquiry into the allegations and pass final orders thereon, after giving due opportunity to the petitioner, within a period of three months from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
