This Writ Petition is filed seeking to declare the action of the second respondent, in not releasing the stocks i.e., 21 bags of black jaggery, each containing kgs, total 1008 kgs, in Cr.No.119/2018 on the file of the Station House Officer, Korukonda Prohibition & Excise, East Godavari District, inspite of readiness of the petitioner to furnish third party surety, as illegal and arbitrary.

Having heard the learned counsel for the petitioner and the learned Government Pleader for Excise appearing for the respondents, this Writ Petition is disposed of, leaving it open for the petitioner herein to move an appropriate application before the Deputy Commissioner of Prohibition & Excise, Kakinada, East Godavari District-second respondent herein, for release of the seized stocks, under the provisions of the A.P.Excise Act, within a period of one week from today, and with a direction to the second respondent to decide the application, if any, filed in the said direction by the petitioner herein, within a period of two weeks thereafter.
