THE HONOURABLE SRI JUSTICE P.NAVEEN RAO Writ Petition No.17602 of 2019 ORDER:

Petitioners claim that they purchased land to an extent of 855 Sq.Yds., in Sy.No.272/2, Quthbullapur Village and Mandal. The sale deed executed by the Vendor was sought to be presented before the Sub Registrar, Quthbullapur, but the Sub Registrar refused to receive the document. No proper reasons are assigned but petitioners were orally informed that the property in issue is included in the list of prohibited properties as per Section 22-A, therefore, cannot be accepted for registration.

According to the learned counsel for the petitioners the notification by which the property is included in the list of prohibited property is not furnished. However, material on record did not disclose proof of submission of document before the Registering authority and required stamp duty is not paid so far. Therefore, it cannot be said that there is inaction on the part of the Registering authority in accepting the document to process for registration as contended. Granting liberty to the petitioners to present the documents for registration evidencing the purchase of the land to an extent of 855 Sq.yds., in Sy.No.272/2 of Quthbullapur Village and Mandal to the 3rd respondent, Sub Registrar, by paying requisite stamp duty as applicable in that area, this Writ Petition is disposed of.

If such document is presented by paying requisite stamp duty, Registering authority shall receive and process the document and communicate his decision within four weeks, from the date of submission of document. If the Sub Registrar is not accepting the document for registration he shall assign reasons for the said decision.

Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous applications, if any pending, shall stand closed.
