THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.9796 of 2017 ORDER:

The petitioner claims to be the owner of Flat No.G-3, ground floor, Plot No.83 situated at Sri Shanti Apartments, Kalyan Nagar, East Anandbagh, Malkajigiri, Hyderabad. He let out the said flat to one Sri Srujan Kumar on a monthly rent. However, the said portion was raided by the Station House Officer, Malkajigiri Police Station, who registered Crime No.600 of 2016 under Sections 3, 4 and 5 of the Immoral Traffic (Prevention) Act. The flat was seized by the Police pursuant to the registration of crime. When the second respondent passed an order on 24.11.2016 under Section 133 of Code Criminal Procedure, the present Writ Petition is filed. In the circumstances, this Writ Petition is disposed of giving liberty to the petitioner to approach the second respondent for appropriate orders for release of the premises and as and when such representation is received, it is for the second respondent to consider the same in accordance with law and pass appropriate orders. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
