The present writ petition is filed to declare the action of the respondent Nos.2 and 3, in not acting on the representation of the petitioner, which was acknowledged on 04.05.2019 & 06.05.2019 and also not conducting proper investigation in Crime No.84 of 2019 of Moinabad Police Station, as being illegal and arbitrary.
Heard Sri H. Sudhakar Rao, learned counsel for the petitioner and the learned Government Pleader for Home appearing for the official respondents 1 to 5 and Sri S. Lokeswara Reddy, learned counsel appearing for the de facto complainant, who is 6th respondent in the writ petition. Counter affidavit has been filed by the 3rd respondent-Deputy Commissioner of Police, Shamshabad Zone.
On going through the counter filed on behalf of the 3rd respondent, reveals that pursuant to the complaint of 6th respondent, a case was registered in Crime No.84 of 2019 for the offence under Section 174 of Cr.P.C. on the file of 4th respondent-Station House Officer, Moinabad Police Station. Upon registration of crime, the Investigation Officer took up the investigation by visiting the scene of offence situated at Yenkepally Village, Moinabad Mandal, secured mediators, conducted the scene of offence and drafted the rough sketch
of scene of offence, where the deceased committed suicide by hanging with rope. The said rope was seized in the presence of mediators and shifted the dead body of the deceased to Osmania General Hospital, Hyderabad, for post mortem examination.
It is further stated in the counter, that during the course of investigation, four witnesses were examined and recorded their detailed statements. Further, the Medical Officer issued opinion that the cause of death is "due to hanging". Further, it is stated that based on the evidence and merits of investigation, it revealed that the deceased being depressed over his life hanged himself in his room to ceiling fan with rope. The counter affidavit further states that the Assistant Commissioner of Police, Rajendranagar Division accorded permission to refer the case as "suicidal death due to hanging", vide No.43 ACP-RJNR/2019, dated 25.03.2019 and that after serving notice to the complainant, the final report as "suicidal death due to hanging" was filed on 16.08.2019 before the Mandal Executive Magistrate, Moinabad.
Having regard to the said submissions made on behalf of the 3rd respondent, since the final report has already been filed, no further orders are required to be passed in this writ petition. The writ petition is accordingly closed.
