HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5305 OF 2019 ORDER:

This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') is filed by the petitioner - owner viz., Shahnawaz Ali Khan seeking to quash the order dated 15.07.2019 passed by the learned Judicial Magistrate of First Class, Narsapur, Full Additional Charge of the learned Judicial Magistrate of First Class, Medak, in Criminal M.P. No.174 of 2019 in C.C. No.429 of 2018.

2. Heard Sri Y.V.V.V.S. Jwaala, learned counsel for the petitioner, and learned Additional Public Prosecutor appearing for the State, and perused the material on record.

3. Though the present Criminal Petition is filed seeking to quash the aforesaid proceedings against the petitioners, learned counsel for the petitioner restricts the prayer seeking to modify the order impugned.

5. Having regard to the facts and circumstances of the case and in view of the prayer made by the learned counsel for the petitioner, the order impugned is modified to the effect that the petitioner shall execute a personal bond for Rs.1,00,000/- (Rupees one lakh only) with one surety for a like sum with an undertaking to produce the property in the same condition before the trial Court as and when

directed. All other conditions imposed by the trial Court shall remain as it is.

6. With the above modifications, the Criminal Petition is disposed of.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the criminal petition stand closed.
