I.A.No.1 of 2022 This Interlocutory Application is filed by the petitioner/accused under Section 439 (1) (b) of the Criminal Procedure Code, 1973 seeking relaxation of condition No.2 imposed while granting bail to the petitioner in Criminal Petition No.6741 of 2021 vide Orders dated 09.09.2021. Heard Sri C. Hari Preeth, learned counsel for the petitioner as well as Sri Sridhar Chikyala, learned Special Public Prosecutor for AntiCorruption Bureau. As seen from the Order, the condition No.2 imposed while granting bail to the petitioner in Criminal Petition No.6741 of 2021 vide Orders dated 09.09.2021 is: 'After release on bail, the petitioner/accused shall appear before the Deputy Superintendent of Police, Anti-Corruption Bureau, Adilabad Range, on every Monday and Thursday between 11:00 AM., and 12:00 noon till filing of charge sheet.'
It is submitted by the learned counsel for the petitioner that he has been attending regularly before the Deputy Superintendent of
Police, Anti-Corruption Bureau, Adilabad Range, on every Monday and Thursday between 11:00 AM., and 12:00 noon, as per the directions of this Court, without any default and investigation is almost completed and that the petitioner is resident of Khanapur town of Nirmal District and facing much difficulty in attending before the Deputy Superintendent of Police, Anti-Corruption Bureau, Adilabad Range.
Learned Special Public Prosecutor for AntiCorruption Bureau has submitted that investigation is completed and the Special Public Prosecutor for Anti-Corruption Bureau is waiting for proceedings of the Government for initiating prosecution against the petitioner.
Considering the circumstances, the condition No.2 imposed while granting bail to the petitioner in Criminal Petition No.6741 of 2021 vide Orders dated 09.09.2021, is hereby relaxed. ___________ Dr.DNR,J KHRM
