HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.7161 of 2024 ORDER :

Petitioner/A-2 has filed this petition seeking bail in Cr.No.125 of 2024 of P.S.Gopalapuram, registered for the offences under Sections 8(c), 20(b)(ii)(B) and Section 27-A, 29 of NDPS Act r/w. 34 of IPC.

Heard learned counsel for petitioner and the learned Additional Public Prosecutor appearing for the State.

The allegation against the petitioner is that he was supplying dry ganja by purchasing the same from A-1. There were about 8 cases against the petitioner, out of which, 5 are under NDPS Act, therefore, he is an habitual offender.

The grounds for seeking bail are that the petitioner herein was arrested basing on the confession of A-3 to A-5 in the case. It is contended that he has been in jail since 01.04.2024 and that the petitioner is a law-abiding citizen and is ready to co-operate with the Police in investigating the case and that he will comply with the conditions that may be imposed by this Court in the event of his release.

The learned Additional Public Prosecutor opposed the application contending that the petitioner is a habitual offender and hence, he cannot be granted bail.

Having heard both sides and perused the material on record, since the petitioner is arrested merely basing on the confession of other accused in the crime, this Court is of the considered view that it is a fit case for grant of bail, however, subject to the following conditions :

(i) The petitioner shall be released on bail on his executing a personal bond for Rs.20,000/- with two sureties for the like sum each to the satisfaction of the X Additional Chief Metropolitan Sessions Judge, Secunderabad. Iii) The petitioner shall appear before the concerned Investigating Officer every day between 10.00 a.m. and 12.00 noon till filing of charge sheet.

Petition is accordingly allowed.
