P Srinivas v. P Srvya Sri
HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CIVIL REVISION PETITION No.2909 OF 2018 ORDER:
Heard Sri B. Sandeep Kumar, learned counsel for Sri P. Vishnuvardhana Reddy, learned counsel for the petitioner on record.
2.
The present Civil Revision Petition is disposed of at the admission stage itself for the reason what was granted towards interim maintenance was not even reasonable when kept in view, the present day spiralling prices of all essential commodities, shelter and clothing. 3.
Respondent-wife sought interim maintenance of Rs.15,000/- per month in I.A. No.162 of 2017 in Divorce H.M.O.P. No.51 of 2017 pending on the file of Principal Senior Civil Judge, Kothagudem, and also sought for Rs.10,000/- towards legal expenses. The matter was contested by the husband. The Court below, balancing the status of the parties, recorded a finding that the petitioner-wife is not employed, though, highly educated and the respondent-husband has been working as Analyst in Disha Core N Core Software Company, Hyderabad, and disbelieving the stand taken by the respondent-husband that the petitioner-wife has been earning Rs.20,000/- per month and she is also running Maruti Car Service Centre at Kothagudem, awarded Rs.5,000/- towards interim maintenance per month and granted Rs.2,000/- towards legal expenses as against Rs.10,000/- claimed by her.
4.
Learned counsel, though, would submit that the respondent-husband is not earning that much amount as stated in the order, however, he is not certain what was the amount the respondenthusband has been earning nor it was averred in his counter. Nothing prevented him to come out with true picture, when he was resisting grant of maintenance and ought not to screen what has been the income and that itself would expose that the respondent is not fair enough in his stand.
5.
Learned counsel would clearly admit that the respondentwife herein is not employed, though highly educated. Howsoever, the wife is educated that cannot be a ground to deprive her or decline to grant interim maintenance sought for by her. The amount of Rs.5,000/- per month granted towards interim maintenance, in fact, is not even just reasonable and also Rs.2,000/- granted towards legal expenses appears to be very meagre.
6.
Hence, there is no merit in the present Civil Revision Petition, and, accordingly, the same is dismissed. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions if any pending in the Civil Revision Petition shall stand closed. _________________________ A.SHANKAR NARAYANA,J Dt. 15.06.2018 gbs
