THE HON'BLE SRI JUSTICE R.SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.34787 of 2015 ORDER: (Per Hon'ble Sri Justice R.Subhash Reddy) In this writ petition, the petitioner has questioned the order dated 07.09.2015 passed in Crl.M.P.No.134 of 2015 by the Chief Judicial Magistrate, Nalgonda, in exercise of powers under Section 14 of the SARFAESI Act, 2002. The validity of the aforesaid order is questioned mainly on the ground that the Chief Metropolitan Magistrate and the District Magistrate are only competent to pass orders under Section 14 of the SARFAESI Act.

On instructions, at the stage of admission, it is submitted by Sri Podila Hari Prasad, learned counsel appearing for the 1st respondent Bank, that the Bank is intending to approach the District Magistrate and undertakes not to enforce the order passed by the Chief Judicial Magistrate, Nalgonda, in Crl.M.P.No.134 of 2015. In view of the aforesaid submission of learned counsel for the 1st respondent, we deem, it is not necessary to go into the validity of the impugned order. Hence, placing on record the submission of learned counsel for the 1st respondent, the writ petition is disposed of. No order as to costs.
