THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE G. SHYAM PRASAD WRIT PETITION No. 42689 of 2016 ORDER: (Per VRS,J) The petitioner, who appeared for selection to the post of Police Constables, but who was not successful, filed an application in O.A.No.4243 of 2016 on the file of the Andhra Pradesh Administrative Tribunal, seeking a direction to consider his case under the quota reserved for Home Guards. The Tribunal dismissed the application, on the ground that in the examination, the petitioner did not secure the pass percentage. Aggrieved by the said order, the petitioner is before us.

2.

Heard Mr. M. Venu Madhav, learned counsel for the petitioner. 3.

There is no doubt about the fact that there is a special representation for certain special categories at a fixed percentage for recruitment to the post of Police Constables. For Post Code No.21, which relates to Stipendiary Cadet Trainee Police Constables (Civil), 8% of the post is reserved for Home Guards. For Post Code No.22, namely, Stipendiary Cadet Trainee Police Constables (AR), there is a

5% reservation for Home Guards. There is no dispute that the petitioner is entitled to be considered under the said quota. 4.

But, in the written examination, all the candidates in the open category are required to secure 40% marks. The maximum marks for Post Code No.21 was 200. Therefore, the petitioner, who belongs to O.C., should have secured 80 marks. Unfortunately, he secured only 56 marks. Therefore, the rejection of his application by the competent authority and the rejection of his claim by the Tribunal are perfectly in order and they do not call for any interference. Hence, the Writ Petition is dismissed.

Consequently, miscellaneous petitions if any pending in the writ petition shall stand dismissed. No order as to costs. __________________________ V. RAMASUBRAMANIAN, J _____________________ G. SHYAM PRASAD, J 8th December, 2016 cbs
