Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. The petitioner was appointed as a Fair Price Shop Dealer of Shop No.33 of Nagisettipalli Village, Kolimigundla Mandal, Kurnool District. The authorization is valid up to 31.03.2017. While so, the Deputy Tahsildar (CS), Banaganapalli, visited the shop and noticed certain irregularities and submitted a report dated 25.03.2015. Based on the said report, the 3rd respondent suspended the authorization pending enquiry by proceedings dated 30.04.2015. Challenging the same, the present writ petition is filed.

3. Against the impugned order dated 30.04.2015, the petitioner preferred an appeal before the 2nd respondent on 29.05.2015 along with a stay petition of even date and the same is pending. Hence, this Court is not inclined to consider the validity or otherwise of the said order. However, since the petitioner had already filed an appeal along with a stay petition, the 2nd respondent is directed to consider the stay petition filed on 29.05.2015 and dispose of the same within one week from the date of receipt of a copy of the order.

4. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 19th June, 2015 cbs
