HON'BLE SRI JUSTICE A. SHANKAR NARAYANA M.A.C.M.A. No.1719 of 2005 JUDGMENT:

The controversy in the instant appeal is, whether the crime vehicle bearing registration No.AP 9U 5355 was holding valid insurance policy on the date of the accident. The copy of insurance policy marked as Ex.B.1 with policy No.2335 relates to the vehicle bearing registration No.AP 25T 5221, but does not relate to the vehicle bearing registration No.AP 9U 5355 and in view of the same, the Tribunal dismissed the claim petition, which is under challenge herein. There is no representation for the appellant. Earlier, it was once listed under the caption 'for dismissal'.

Even then also the learned counsel for the appellant has not come forward to tender arguments and the learned counsel for the 2nd respondent-Insurance Company tendered arguments in part and sought time to find out whether any claims were preferred by any other who received injuries, since there was one death also in the same accident. Therefore, it was listed today under the caption 'part-heard'. Meanwhile, the Registry was also directed to verify any matters were pending arising out of the same accident. The Registry has noted with pencil that no appeals are pending.

Hence, the instant appeal is dismissed for non-prosecution. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending in this appeal, shall stand disposed of.
