THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.29233 of 2016 ORDER:
The petitioner was appointed as a Mechanic in the year 1991. There was an allegation of unauthorized absence from 26.09.2012 to 25.10.2012. An enquiry was conducted and an order of punishment of deferment of one annual increment with cumulative effect was passed on 04.08.2015. Challenging the same, the present Writ Petition is filed. When this Court pointed out with regard to the existence of right of appeal, learned Counsel for the petitioner submits that the impugned order dated 04.08.2015 was approved by the appellate authority as could be seen from the seventh reference of the impugned order. Learned Standing Counsel for the respondents fairly submits that in spite of approval of the impugned order by the appellate authority, the appellate authority would consider the appeal of the petitioner impartially and in accordance with law as and when the petitioner prefers the appeal against the impugned order.
In the circumstances, this Writ Petition is disposed of giving liberty to the petitioner to prefer the appeal against the impugned order dated 04.08.2015, within a period of two weeks from the date of receipt of a copy of this order, and the appellate authority shall consider the appeal as and when received by him in accordance with law, and pass appropriate orders thereon, within a period of eight weeks thereafter. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
